1. Scope and Object of the General Store Conditions
1.1 These General Conditions are intended to regulate the terms and conditions governing the provision of the Service Meet the Portuguese (hereinafter referred to as the “Service” or “Store”), by the company Meet the Portuguese, with registered office at Rua Dom Dinis, n.º 154, 4.º Esq., 2785-723 São Domingos de Rana, registered at the competent Commercial Registry Office under the single registration and legal person identification number no. 518 618 528, hereinafter referred to as “Meet the Portuguese”.
1.2 The Service consists of providing, via the address https://mtp-tours.com, access to the Website that provides information on a range of tourism products and/or services, allowing the User to book Tours electronically, under the terms and conditions described herein.
1.3 Tours must be booked by Users aged 18 (eighteen) or over. Underage Users must be duly authorized by their legal representatives.
1.4 By accessing and using the Website, the User declares to have read, understood and fully accepted these General Conditions.
1.5 If the User does not agree with these General Conditions, he/she must refrain from using the Website and its Services.
1.6 Meet the Portuguese reserves the right to change these Terms and Conditions at any time, with the date of the last update duly indicated.
2. Product Information and Content
2.1 Meet the Portuguese will make every effort to ensure that the information presented on the Website is free of typographical errors or inaccuracies. In the event of any relevant non-conformity, the User may exercise their rights under the applicable legal terms.
2.2 In exceptional situations and for reasons beyond the control of Meet the Portuguese, it may not be possible to guarantee the booking of the Tour under the conditions initially requested, and the User will be duly informed and may choose to cancel the booking with a refund of the amount paid.
2.3 Meet the Portuguese reserves the right to change prices, tour characteristics, content, promotional actions and services at any time.
3. Responsibilities
3.1 All services marketed by Meet the Portuguese comply with applicable Portuguese legislation.
3.2 Meet the Portuguese shall not be liable for damages resulting from delays, interruptions, errors or suspensions of communications due to factors beyond its control.
3.3 Use of the Service is presumed to have been made by the User, and Meet the Portuguese declines any responsibility arising from abusive or fraudulent use.
3.4 Meet the Portuguese shall not be liable for any loss or damage for which it is not responsible through intent or gross negligence.
3.5 Meet the Portuguese is not responsible for situations of force majeure, such as natural disasters, government decisions, strikes, armed conflicts, power failures or other extraordinary circumstances.
3.6 The User accepts that Meet the Portuguese does not guarantee that the Service will be provided continuously, free from errors or interruptions.
3.7 Meet the Portuguese cannot be held liable for indirect damages, loss of profits or loss of data resulting from the use or inability to use the Service.
3.8 Health and Safety
The User acknowledges and accepts that participation in the Tours is at his/her own risk and that he/she is entirely responsible for his/her own health and safety during the Tours.
The User undertakes to inform Meet the Portuguese in advance of any medical conditions, physical limitations, special needs or other relevant circumstances that may affect their participation in the Tour, in order to allow, whenever possible, the adequate preparation and adaptation of the Service. The omission or inaccuracy of this information exonerates Meet the Portuguese from any responsibility for incidents, damages or losses that may result.
Without prejudice to the provisions of the preceding paragraphs, participants are covered by Personal Accident Insurance, under the legally applicable terms and conditions of the respective policy, which does not exempt the User from adopting all precautions and diligent behavior appropriate to their personal safety.
4. User obligations
4.1 The User undertakes to provide true, complete and up-to-date data, as well as to respect all the rules of participation in the Tours.
4.2 Failure to comply with the obligations assumed may result in the cancellation of the appointment, without the right to a refund, as well as the refusal of future appointments.
5. Privacy and Personal Data Protection
Personal data is processed in accordance with the applicable legislation, namely the General Data Protection Regulation (GDPR). The User can consult the Privacy and Cookies Policy available on the Website.
6. Confirmation and punctuality
6.1 After payment, the User will receive confirmation of the date, time and place of the Tour.
6.2 The User undertakes to show up at the agreed location at least 20 (twenty) minutes in advance.
6.3 The User's lateness or non-attendance may result in the loss of the right to participate in the Tour, and such a situation will be considered no-show, There will be no reimbursement.
7. Canceling appointments
7.1 Cancellation at the User's initiative must be requested up to 24 hours before the Tour takes place.
7.2 Cancellations made less than 24 hours in advance are not eligible for a refund.
7.3 Meet the Portuguese reserves the right to cancel or change Tours for operational, safety or force majeure reasons, assuring the User of the possibility of a refund or rescheduling.
8. Payment
The Services must be paid for in advance using the means provided on the Website.
9. Prices and invoicing
The prices shown include VAT at the legal rate in force. If the user wishes to be invoiced with a VAT number, they must provide this information when booking.
10. Intellectual property
All the contents of the Website are protected by copyright and industrial property and may not be used without prior authorization.
11. Complaints and Dispute Resolution
The User may resort to the alternative dispute resolution mechanisms legally provided for.
12. Applicable Law
These General Conditions are governed by Portuguese law. In the event of divergence between language versions, the Portuguese language version shall prevail.
